Cette obligation s\u2019articule \u00e0 travers deux aspects\u00a0: pr\u00e9venir le harc\u00e8lement psychologique et sexuel et le faire cesser s\u2019il survient ou s&rsquo;il est all\u00e9gu\u00e9.<\/p>\n\n\n\n<p><strong>Voici un aide-m\u00e9moire en mati\u00e8re de harc\u00e8lement au travail pour vous rappeler les grandes lignes de vos responsabilit\u00e9s comme employeur.<\/strong><\/p>\n\n\n\n<p>Selon la Loi sur les normes du travail, le harc\u00e8lement au travail se d\u00e9finit comme suit&nbsp;:<\/p>\n\n\n\n<ul><li>Une conduite vexatoire<\/li><li>qui se manifeste de fa\u00e7on r\u00e9p\u00e9titive (un seul \u00e9v\u00e9nement pourrait \u00eatre suffisant si celui-ci est jug\u00e9 suffisamment grave et a les m\u00eames cons\u00e9quences qu\u2019une conduite r\u00e9p\u00e9t\u00e9e)<\/li><li>de mani\u00e8re hostile ou non d\u00e9sir\u00e9e<\/li><li>qui porte atteinte \u00e0 la dignit\u00e9 ou \u00e0 l\u2019int\u00e9grit\u00e9 psychologique ou physique de la personne<\/li><li>qui entra\u00eene un milieu de travail n\u00e9faste ou, dans le cas de la conduite grave unique, un effet nocif continu.<\/li><\/ul>\n\n\n\n<p>Pour d\u00e9montrer qu\u2019il s\u2019agit de harc\u00e8lement, ces cinq (5) \u00e9l\u00e9ments doivent \u00eatre pr\u00e9sents.<\/p>\n\n\n\n<p>Au Qu\u00e9bec comme au Canada, un employeur est responsable de prodiguer un milieu de travail exempt de harc\u00e8lement, et ce, respectivement selon la Loi sur les normes du travail et selon le Code canadien du travail. Il a une obligation de moyens et non de r\u00e9sultat, ce qui signifie que l\u2019employeur doit tout mettre en \u0153uvre pour \u00e9viter qu\u2019une situation de harc\u00e8lement survienne sans pour autant garantir d\u2019y parvenir. Dans le doute ou face \u00e0 des all\u00e9gations de harc\u00e8lement, l\u2019employeur est dans l\u2019obligation d\u2019agir et de mettre en place un processus qui permette le r\u00e9tablissement de la situation.<\/p>\n\n\n\n<p>Diff\u00e9rents moyens sont pris par les organisations, les associations et les entreprises pour tenter d\u2019assurer un milieu et un climat de travail sain et harmonieux tels que&nbsp;:<\/p>\n\n\n\n<ul><li>l\u2019\u00e9laboration, la mise en place et la mise \u00e0 jour d\u2019une Politique de pr\u00e9vention, de sensibilisation et\/ou de redressement en mati\u00e8re de harc\u00e8lement au travail<\/li><li>l\u2019accompagnement et la formation aupr\u00e8s de tous les membres de l\u2019organisation en mati\u00e8re de harc\u00e8lement au travail, de climat sain et harmonieux<\/li><li>la mise en \u0153uvre d\u2019un code de vie, de modes de fonctionnement et de processus de communication clairs et efficaces entre tous les membres de l\u2019organisation<\/li><li>l\u2019application diligente et rigoureuse de la Politique organisationnelle en mati\u00e8re de harc\u00e8lement au travail en cas de plainte et\/ou d\u2019all\u00e9gations, et ce, dans le respect de la confidentialit\u00e9<\/li><li>l\u2019instauration de mesures visant \u00e0 faire cesser le harc\u00e8lement, le cas \u00e9ch\u00e9ant.<\/li><\/ul>\n\n\n\n<p>Efficacit\u00e9, rigueur et confidentialit\u00e9 sont de mise au traitement d\u2019une plainte de harc\u00e8lement au travail.
